A recent US supreme court ruling (or lack thereof) indicates to me that
state building codes (and electrical codes, and mechanical codes, etc.)
are considered to be in the public domain and therefore should be
available for free, plus delivery costs (printing or downloading or
whatever).  As you suggest, a small local surcharge on building permits
should be able to make local building codes available on line.
