Depends what you're doing, and your OS:

Freebsd box running bittorrent, downloading from many sources - no
problem.
Windows 95 web browsing from one site - not likely.

Quite a few Windows customers had been hit by using TCP 'optimisers',
that they ran when they had dial-up.  Up until now the dial-up
settings weren't noticeably bad, but at 20meg, it throttles right back
to <10 :-(

I agree, that's exactly what they should do.  The ASA could enforce
this by saying that 'up to' is, on average, a misleading statement.
However the ASA is a gov agency, and so likes to work with private
money, rather than fine.

What *really* peeves me, is even when I sync my BT VISP ADSL for a
couple of weeks to 8meg, BT's BRAS throttles me below that - so I
don't think any BT line customer (on BT LLU option 3/4) can EVER get 8
meg !!! (without ADSL2+)
