If you have signed for a 12 month contract then BT or any other company are within their rights to hold you to the contractual terms. If they decide to waive part of the contract then that is their option they don't have any obligation to do it.
 
It is the other side of the coin when compared to the Kodak thing....we can't have it both ways contract law is their to protect both parties!
 
I (like several other people on this group) run my own company, if someone signs a contract with me then I expect them to keep it. OK BT is a big company compared to my one man band but the concept is the same.

They'll "fix" your problems and keep you to the contract...

...to be honest you have signed up for 12 months and that's that. I'm in
the same situation with my BT Surftime/ISDN account in that I'm tied in
for a year no metter what.

But as has been pointed out that's not likely as the upgrade would be to
wires only...
