rioplay stuttering

i've been using the rioplay xpl version for a few days now. i have
been using the xplsend command line sender in a batch file to turn on
the rio, queue up a playlist, set the volume & play. then after a
while, i'll power it down. after several iterations of this, it'll
power on & start playing, but the music will be stuttering. the
menu
control is VERY slow, as if there's a runaway process sucking up the
cpu. the only thing i can do is power cycle it. it's happened 3
times in less than a week on 2 different rios. is this a known problem?
