The spec is open and effectively licence free.

There are various implementations of xAP components which comply with
the spec, and the licensing terms are determined by the individual
contributors. Most seem to be choosing a GPL style license - ie.
unencumbered reuse provided acknowledgement and source code is
included in the distribution of the derivative work.

My own components are currently distributed free, with source code,
on the proviso that they are not used commercially/on a for-profit
basis. That's not to rule out future commercial use, simply to retain
some say in any potential commercial offering. Ultimately, were
Polaron to choose to support the protocol, it would provide a
worthwhile boost to xAP credibility.
