RE: UK spec Audiotron Bulk Buy

Title: Re: [ukha_d] UK spec Audiotron Bulk Buy
My view is that the "bulk buys" to date have been arranged for the benefit of the group, and any profits have been returned.

If someone's making a profit, then I think they ought to realise that they're acting as a reseller, and have the same obligations under the eyes of the law as any other reseller - like a "grace period" in which the purchaser can return the goods and demand a full refund (a legal obligation of any purchase made over the internet, under the Distance Selling Directive.)

Now, I realise that many of those who participate in the bulk buys are people we know, and are friends with, but in the recent bulk buy I arranged for Rios, I didn't recognise half of the names!

In that case, the purchase was made directly between the individuals and SonicBlue UK - I didn't receive any money either profit or commission.

However, if I'd done a "send me your cheques" deal, and something had gone wrong, then I'd have been PERSONALLY liable for making good under the eyes of the law, if one of these unknown-to-me people had demanded a replacement / repair / refund.

I think that if something's a "UKHA Bulk Buy", then it should be understood that there's no profit, and this is simply a group of friends purchasing in union. And I believe that the courts would understand that... the moment there's a "I'm buying this, send me cash in advance, and I'm making a profit" then that disappears.

John Tankard, and Gareth Cook, in the WAP and Fuji purchases all made it clear that this was "at cost", and any over-payments would be refunded.

I have been contacted by a member of the list asking me for guidelines on
Bulk Buys.   He is concerned that a private individual making a profit on a
bulk buy is really no different to any other dealer advertising on this
list.

My answer is that no one is forcing anyone to take part in any bulk buy and
it would be very hard to "enforce" any guidelines.

What do others think?

Thanks

M.
