This whole case against Jim reeks. It flies in the face of the foundation of
every tort claim I've ever heard of  where you have to PROVE UP the damages
you claim to have suffered. Where are the damages justifying the tremendous
waste of legal resources of Brinks'? Smashing one little guy for some
alleged copyright infringement? Huh? How does that make any sense?
Conversely, now that Jim has been properly subdued, where is the benefit to
Brinks' bottom line? Just how has Brinks been made whole again, or what cash
leak was plugged? Where are all of the Jim wannabees they seem to fear? Can
they find another single one? And how would have Brinks been made whole by
Jim after prevailing against him as they knew they would? What resources of
Jim's did Brinks plan to send the sheriff to grab so as to recover their non
existent damages? The only damages I can see to Brinks from all of this are
the legal fees involved.
ADT has real lawyers. It is a company that has real money. If Brinks reached
into ADT's operations, I think they will pull back a stump, not a default
judgment. When does the schoolyard bully ever go after the meanest toughest
kid he can find, let alone his equal? By showing their true colors of just
what and who they really are, they went after Jim instead. The best defense
for Jim would have been to defend himself using techniques similar to a
hog-nosed snake's.
It is easy for the average person that has not had any real contact with the
legal system to underestimate its dangers as Jim seems to have done. Even
though many here showed him our collective teeth marks, he did what he did
anyway. Now he has his own teeth marks to show the next person who tries to
walk in his shoes. It is sad to see what has happened so far, but it was
easy to see it coming. When a single individual is fighting against the
legal hands of a big company, you have to be very slippery and get away
quickly from their grasp as well as the focus of their attention. The
problem is when you stay slippery too long, one day you wake up to find you
have become nearly as slimy as your oppressor.
Or worse, you end up with a mama's boy face with a bad comb over and as a
grown man you still behave like a bully still too terrified to take on
anyone your own size.
