NO!! I don't want to start a huge flame or debate either!

The point of the post is to warn everyone to be careful when dealing with
these guys.

  again, I should point out that the Act states "...goods shall
be of
  merchantable quality and fit for stated purpose..." (not quoted
directly
  from Act)

  Having made your requirement known at the time of purchase, I would
enforce
  this right.  If you paid by credit card, then you may have some
redress with
  them too.  Either way I wouldn't let them shaft you like
this.
