My understanding is that its perfectly legal (at the moment) to scan for
nodes
but that it is probably illegal to actively connect to a network that you
don't
have permission to. Having said that if someone leaves an open node with no
WEP
encryption or MAC filtering and DHCP then for all you know they don't mind
people
accessing there system for free !

At the end of the day this is all relatively new technology and the law
hasn't
caught up with it ..yet :)

what is the legality of scanning for nodes?

I guess using an non-public non-wep one is against computer misuse act?
