Could be right, but the way I read it was that any channels provided under
the TV Licence had to also be available FOC on *any* new platform to comply
with the legislation. This was done to ensure that DTV wasn't a dead duck
before it started, also needed if they wanted to switch off analogue but
get
someone other than the BBC or the government to fund the transmission
equipment.

Apart from that, having paid your TV Licence you do have a right to be able
to watch those channels irrespective of the platform that they are offered
on, it's up to you to provide the equipment to receive it though.

Or at least, that is my understanding of it.
