Just to play devil's advocate guys - I have been reading all these mails about Kodak & for whatever reason, malicious employee or otherwise, they did make a mistake in the pricing of this product on their website & tried to rectify it as soon as possible. You can say you have a 'contract' with Kodak however I am sure that this 'receipt' of an email is automatically sent upon receiving the order & it isn't until the order is processed that a human actually 'sees' the order. One may feel it derisory of Kodak to offer 10% discount to you on other products but it is an indicator of their acceptance that they did make a mistake.
 
Don't get me wrong - if I had ordered, in good faith, I would certainly be disappointed if i was told of this error but feel I could accept that mistakes do happen & leave things be - afterall I wouldn't have lost anything. No-one is going to force anyone to use the Kodak site again & I'm sure one wouldn't if one was very upset with Kodak for the website error.
 
So I guess what I'm saying is when mistakes happen some people will accept this whilst some people will be enraged & start a personal vendetta against Kodak ( or it could be any company).
 
Goodwill, tolerance & common sense seem to have gone out of the window in this 'blame' culture.

I called my local TS office and the very nice lady there and I had a little chat, the general gist of it goes….

 

Me: hi I’m calling about the Kodak offer on the internet

Her: ah yes, I read about that in the newspaper this morning, did you buy one?

Me: yes, so did a good friend and my Uncle and we have been told that we are not getting the product.

Her: Oh!

Me: (general explanation of the mail and some the conversations from here and elsewhere on the web)

Her: if you have a proof of purchase that is a receipt for that price then that is a legally binding contract and if the wording is as you say then Kodak could be in trouble.

Me: (asked about the fact that it is normal practise not to charge the card until the goods are dispatched)

Her: yes, that is normal practise from most mail order and internet sellers

Me: so do you think I have a case?

Her: Oh yes, I’ll check with the other TS offices and get back to you, can you send me a copy of the e-mails.

Me: yes, and I’ll get the other people involved to do the same

Her: that would be wonderful as the more people involved then the more pressure we can put on Kodak.

 

It would seem that the TS folks are not taking too kindly to Kodak’s “carte blanche” attitude to this offer in saying no to all the customers that bought on in good faith and I have to say I did! I genuinely thought that this was nothing more than another bloody good offer brought to us in association with UKHA_D ;-)

 

From what I can gather if the seller offers the product at a set price and you accept that price by issuing your payment details then they issue a receipt then that’s it, game over, the deal is done, according to the nice lady at TS anyway J

 

When you think about it this makes sense as the warranty runs from the date of purchase *not* the date of delivery as is the case with the vast majority of our products that are sold from most major retailers it is only the goodwill of the manufacturer that allows the warranty to be taken from the delivery or collection date *if* you have the paperwork to prove it.

 

A very grey area indeed!

Yes...exactly Michael!  They are trying to compare this to "a shop" where you hand over the cash and the deal is done.  It's different in this case - the deal HAS been done (I have a receipt) and as you point out the reason the money hasn't been taken >from are sent to me!

BTW those other Trading Standards officers are wrong !! The email I received states

"Please keep this message as your receipt of the purchase." So I have a receipt for a purchase and expect my Credit Card to be debited only when the goods have been dispatched. My Online Order status remains @ PROCESSING yet they have changed it to not show the full Credit Card number as it did earlier today. Why have they not cancelled my order??
