Kenneth,
You are correct when you write: "you and the vendor have agreed the
terms and the contract of sale has been made"
The problem is that you have agreed the term which allows the vendor to
choose not to supply you the goods for any "special offer" items
if they
haven't already billed your CC.
Given that this was a "special offer" (see Mark M's post earlier)
then
legally, they probably would win. The question is how much bad will and
bad publicity they can take. Nothing like a hundred letters to Watchdog
to make them come round ;-)

This is the confusing bit for me, as if the confirmation mail is a
"receipt" as per the wording of it and also serves as the proof
of
warranty then, IMO, you and the vendor have agreed the terms and the
contract of sale has been made. That is my understanding of the law,
although I'm pretty sure I'll be proved wrong!
I would lay good odds that Kodak have been down at their barristers
office today :-)
Again, only IMO, if I arse it up like this in my business then too bad,
I have to suffer the loss admittedly though, I have never erred to this
degree.
