Piggybacking since I have yet to recieve the original message from Yahoo.
Selling previously owned goods as new is indeed illegal. Retailers are
allowed to sell second user goods but they must inform you at the time and
not lead you to believe that they are new and unused. A price reduction is
*not* sufficient mitigation unless accompanied by specific information
stating that the goods are second user/refurbished/etc in which case it
becomes part of the Contract of Sale. At the very least, the Trade
Descriptions Act and the Misrepresentation Act apply to this case. There
are
probably later provisions in the newer consumer laws, but they will not
detract from two Acts I mentioned, merely strenthen their protection.
Even if everything goes well after you have chewed up the store manager, it
is worth making Trading Standards aware of the problem so they can take
their bite or at least have it on record. Even if you don't need their
help,
someone else might since I doubt yours will be a one off problem.
Scan pulled a similar stunt with me *twice* on a DVD player (and it's
replacment) many years ago, since when I have avoided them.

What really pisses me off is I expressly asked the sales person whether it
had been previously owned/registered and pointed out that if it had then I
would know as the months free subscription would have lapsed!

Just bought a TiVo from PowerHouse today ... Box was damaged but I was
assured by PowerHouse that the unit was brand new and unused.
I have just called TiVo to register the unit and have been told that the
unit was registered on the 23rd June (and hence the warranty began at
that point) - I also lose the 1 month trial subscription too.
I believe that what PowerHouse have just done (selling previously owned
goods as new no matter what the price) is illegal...
Bastards!
