Aside from the misinformation you were given, BT would not be allowed to do this under the current regulatory climate!  It would be construed, to put it simply, as anti-competitive behaviour. Blame Oftel.

BT are only 'required' to yield 9600bps (I believe) via analogue modems.  This is what is stipulated in the Universal Service Agreement.  Blame Oftel.

Again, communication is not straightforward due to regulatory compliance.  It's no excuse but it does complicate matters.  Blame Oftel.
