I'm involved in one contract at the moment, where a strip of land 1 foot
wide and 60 feet long is probably going to be valued at about =A3300,000.
The point is, it lies between Sainsbury's and a field which they want to
use as an extension to the car-park. The previous owners of the "shop
before Sainsbury's" sold 99% of their land, but retained a
"ransom
strip".

Having spent much of my working life with property developers and
builders, I don't believe that any court in the land would regard a
lowish four-figure sum as an "unreasonable" charge for allowing
trenching to be dug. I would guess that =A33-4 was reasonable, but that
=A38-9k was taking the piss.=20

As you say, a mole would be one way of tunneling, but moleing is
typically 4-5 times more expensive than cut and cover tunnelling.
Overhead wires is, again, an alternative, but telcos tend to hate them
because they get broken ;-)

That's not the main point however... the main point I was making is that
if you want cable access then DEMAND it.=20

Don't let the cable company make excuses! They'll try to flim-flam you,
but in fact they may well be obliged to provide it and NOT have ANY
RIGHT to pass on their costs to you...

The cable company could undoubtedly "mole" the service so that
they wouldn't disturb your plants etc.

I think that you'll find that all the telecomms companies have
rights of access enshrined in their licences and any attempt to
extract unreasonable amounts of cash from them for access would
be frowned upon by a court, which is where any dispute would be
settled.

If they wanted to get naughty they could always erect an aerial
cable across your garden and legally you can't do a thing about
it, ISTR that it's called "flying wire" powers.
